Legal
Terms of use
Effective 2 September 2026. The agreement between your school and AakarLab for use of the ClassUps platform in India.
These Terms of Use (“Terms”) are a legally binding agreement between the school or organisation that registers for ClassUps (the “School”, “you”) and AakarLab (“we”, “us”, “our”), the operator of the ClassUps platform. By creating an account, starting a demo, making a payment, or using any module, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not access the service. Individual teachers, students, and parents use ClassUps under the School’s account and must follow the School’s rules as well as these Terms.
These Terms are governed by the laws of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the Consumer Protection Act, 2019 (to the extent it applies).

1. The service
ClassUps is a cloud school management platform. Modules may include students and staff records, academic sessions and promotion, attendance (manual and ESP32 RFID/QR), fees and online collection, exams and report cards, timetable, parent portals, notices, SMS/WhatsApp/email, admissions, website pages, AI assist, library, laboratory, and backups — as enabled for your plan.
Features, limits (for example extra website pages or file size), and premium modules depend on your subscription or demo configuration. We may add, modify, or retire features with notice where a change is material.
Demo or trial access is time-limited, may include or exclude premium modules, and does not guarantee uninterrupted service or conversion to a paid plan at a particular price.
2. Eligibility and accounts
- The contracting customer must be a school, trust, society, company, or other organisation lawfully operating an educational institution in India (or evaluating the product for that purpose).
- The person who registers warrants that they are authorised to bind the School.
- You must provide accurate school and administrator details and keep them updated.
- You are responsible for all activity under logins you issue. Assign roles (admin, teacher, student, parent) correctly. Do not share administrator passwords.
- Student and parent accounts are provided for the School’s educational administration. Use by a child is under the School’s and parent/guardian’s authority.
3. School obligations (including data protection)
The School is the Data Fiduciary for personal data of students, parents, and staff that it enters into ClassUps. You agree to:
- Collect and use that data only for lawful educational, administrative, and fee purposes.
- Give notices and obtain consents required under the DPDP Act, 2023 (including verifiable parental consent for children where required) and any state education or board rules.
- Not instruct us to send unlawful, defamatory, or unsolicited promotional messages.
- Keep records accurate; take backups before promotion, imports, restores, or year-end.
- Comply with affiliation, examination, and fee-regulation rules that apply to your institution (CBSE, CISCE, state boards, or others). ClassUps is a software tool; it does not replace your statutory obligations.
- Ensure RFID/QR devices, API keys, and campus networks are used only for authorised attendance marking.
We act as a Data Processor for that school data, as described in the Privacy Policy.
4. Acceptable use
You must not, and must not allow users to:
- Attempt unauthorised access, probe, or disrupt the platform, other schools, or our vendors.
- Upload malware, or content that is illegal in India (including child sexual abuse material, or content that violates the IT Act or criminal law).
- Use the service to harass, defame, or unlawfully monitor individuals beyond genuine school administration.
- Resell ClassUps as your own product, scrape the service, or reverse engineer except as Indian law allows.
- Circumvent plan limits, payment, or module licensing.
- Use AI features to generate harmful, exam-cheating, or unlawfully discriminatory content, or to make automated decisions about a child without appropriate human review.
We may suspend access immediately if we reasonably believe these rules or Indian law are being violated.
5. Fees, GST, and payments
- Platform subscription and optional modules are charged as displayed at checkout or in an agreed invoice. Prices may change for renewal periods with notice.
- Online payments are processed by a payment aggregator (such as Razorpay) under RBI guidelines. You authorise the charge on the selected method.
- Applicable GST and other taxes will be added as required. You must provide a valid GSTIN if you need a tax invoice in your entity’s name.
- School-collected student fees through ClassUps belong to the School (minus gateway charges). We are not a bank or trustee of student fee money beyond facilitating the payment flow you enable.
- Failed, delayed, or disputed gateway payments are handled under the gateway’s and your bank’s rules. Refunds of our subscription fees, if any, follow the policy stated at purchase or required by the Consumer Protection Act, 2019.
- Non-payment after notice may lead to suspension or read-only access, then termination.
6. SMS, WhatsApp, and email
If you enable parent or bulk messaging, you are the sender of those communications. You must:
- Comply with TRAI’s Telecom Commercial Communications Customer Preference Regulations (TCCCPR), including DLT registration and approved templates for commercial SMS where they apply;
- Distinguish transactional/service messages from promotional messages and honour DND/preference rules;
- Comply with WhatsApp Business / Meta terms and anti-spam rules;
- Send only to numbers you are authorised to contact (parents/guardians and staff who have a relationship with the School).
Delivery is not guaranteed. Operator outages, DLT rejection, or user blocks are outside our control. Message credits or third-party charges may apply.
7. Hardware, AI, and third-party services
- RFID/QR devices: Hardware is typically purchased and maintained by the School. We provide APIs and software integration. Device failure, wiring, or campus network issues are the School’s responsibility unless we have a separate written hardware warranty.
- AI assist: Outputs may be inaccurate. Staff must review AI drafts before sending to parents or using in official records. Do not paste unnecessary personal data of children into prompts.
- School public website and gallery: You are responsible for the lawfulness of photos, names, and text you publish (including consent for student images).
- Third-party terms (Razorpay, SMS/WhatsApp aggregators, AI providers, hosting) apply in addition to these Terms.
8. Intellectual property
ClassUps, its software, design, and documentation remain the property of AakarLab or its licensors. The School receives a limited, non-exclusive, non-transferable right to use the service for its own institution during a valid subscription or demo.
Data the School enters remains the School’s data. You grant us a licence to host, back up, and process that data solely to provide the service. Feedback you give may be used to improve ClassUps without obligation to you.
9. Availability, backups, and changes
We aim for reliable uptime but do not warrant uninterrupted or error-free service. Maintenance, force majeure (including failure of electricity, internet, or third-party clouds), or security incidents may cause downtime.
You should export and keep your own backups of critical records. Year-end promotion, bulk import, and restore operations can change data; you must verify results.
We may update these Terms. Continued use after the updated date constitutes acceptance. If you do not agree, you must stop using the service and export your data.
10. Warranties, liability, and indemnity
The service is provided on an “as is” and “as available” basis to the maximum extent permitted by Indian law. We do not warrant that reports, ranks, fee totals, or AI text are free of error. Official decisions (promotion, detention, fee concessions, board submissions) remain the School’s.
Nothing in these Terms excludes liability that cannot be excluded under the Consumer Protection Act, 2019 or other mandatory law (including fraud or wilful misconduct).
Subject to that, our total aggregate liability arising out of the service in a given year is limited to the subscription fees you actually paid us for ClassUps in the twelve months before the claim (or INR 10,000 if you are on a free demo and paid nothing). We are not liable for indirect, special, or consequential loss, loss of profit, loss of data, or examination/board consequences, except where mandatory law says otherwise.
The School will indemnify AakarLab against claims arising from: (a) the School’s student/parent/staff data or messages; (b) the School’s breach of the DPDP Act or TRAI/WhatsApp rules; (c) content published on the School’s public pages; or (d) use of the service in violation of these Terms — except to the extent caused by our proven gross negligence or wilful default.
11. Term, suspension, and termination
- These Terms continue while you have a demo or paid account.
- You may stop using the service and request account closure through an authorised administrator or our contact page. Export data before closure.
- We may suspend or terminate for non-payment, legal risk, or material breach after notice where reasonable (immediate suspension is allowed for security or illegal content).
- On termination we may delete platform data after a short retention window, except records we must keep for tax, dispute, or legal compliance.
12. Governing law and disputes
These Terms are governed by the laws of India. Courts at India shall have exclusive jurisdiction, without prejudice to your statutory rights to approach a consumer commission or other forum that Indian law makes available.
Parties should first attempt to resolve disputes in good faith through the Grievance Officer named in the Privacy Policy. Subject to mandatory law, unresolved disputes may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed mutually (or as the Act provides), with the seat of arbitration at India, in English. You may still use remedies that cannot be waived by contract.
